TERMS & CONDITIONS OF TEMPLATE PURCHASE

These Terms and Conditions apply to the purchase of Squarespace website templates from The Visible Therapist, a trading name of Autumn Creative Ltd, a company registered in England and Wales under company number 15327839, based in Swindon, Wiltshire.

In these Terms, “The Visible Therapist”, “we”, “us” and “our” refer to Autumn Creative Ltd trading as The Visible Therapist. “You” and “your” refer to the person purchasing a template.
By completing a purchase, you confirm that you have read, understood and agree to these Terms and Conditions.
Please read them carefully before purchasing. If you do not agree with these Terms, you should not complete your purchase.
1. ABOUT OUR TEMPLATES
The Visible Therapist sells pre-designed Squarespace website templates created specifically for therapists and counsellors.
Our templates are digital products built for Squarespace 7.1.
Your purchase gives you a licence to use the purchased template for one website for one business only, subject to the licence terms set out below.
Templates are sold on a non-exclusive basis. This means the same template design may be purchased and used by other customers.
Your purchase is for the template and the resources specifically stated on the relevant product page. It does not include a Squarespace subscription, domain name, custom website design, Template Restyle service or any other product or service unless expressly stated.
2. WHO MAY PURCHASE
Our templates are available for purchase by customers around the world:
You must be at least 18 years old to purchase a template.
The templates are intended for therapists and counsellors purchasing a website template for their own practice or business.
Each purchase may be used for one website only. A separate template licence must be purchased for every additional website or business.
We reserve the right to refuse or cancel an order where we reasonably believe that an order has been placed contrary to these Terms, including where a purchaser is located in a territory in which we do not currently sell.
If we cancel an order before the template has been supplied, any amount you have paid for that order will be refunded.
3. ORDERING AND PAYMENT
Templates are purchased through our online checkout provided by Squarespace.
Payment is taken through the payment methods made available at checkout, which may include payment processing services such as Stripe.
Prices are displayed in GBP (£) and include VAT where applicable.
Template purchases are currently payable in full at the time of purchase unless expressly stated otherwise on the product page.
You are responsible for ensuring that the information you provide when placing your order, including your name, email address and billing information, is complete and accurate.
Once your order has been successfully completed, you will receive confirmation of your purchase electronically.
We reserve the right to change our prices at any time. Any price change will apply to future purchases and will not affect an order that has already been accepted.
4. HOW YOUR TEMPLATE IS DELIVERED
Following your purchase, we will prepare your chosen template as a new Squarespace website.
You will then receive an invitation from Squarespace to access the template website.
You will need to provide an email address that can be associated with a Squarespace account.
If you already have a Squarespace account, you should use the email address connected with that account.
If you do not already have a Squarespace account, Squarespace will prompt you to create one when accepting your invitation.
Once you have accepted the invitation, we will manually transfer ownership of the template website to you.
Because ownership transfer is a manual process, delivery is not instantaneous or automated.
5. DELIVERY TIMES
We aim to send your Squarespace invitation within 2 business days of receiving your completed purchase and the information required to prepare your template.
Business days are Monday to Friday and exclude UK bank holidays.
We will always do our best to deliver templates promptly and may choose to process orders during evenings, weekends or bank holidays. However, these periods do not count towards the 2-business-day delivery timeframe.
Occasionally circumstances outside our reasonable control may cause a delay. If you have not received your invitation after 2 business days, please contact support@thevisibletherapist.co.uk so that we can investigate.
We are not responsible for delays caused by:
* incorrect information supplied by you;
* emails being directed to spam or junk folders;
* problems with your email provider;
* Squarespace outages or technical problems;
* failure to create or access your Squarespace account; or
* other circumstances outside our reasonable control.
6. YOUR SQUARESPACE TRIAL
Your template will initially be supplied as a Squarespace website with a 6-month trial period, where that trial is made available by Squarespace.
You are responsible for accepting the invitation, maintaining access to the website and upgrading the website to an appropriate paid Squarespace plan before the trial expires if you wish to continue using it.
You have the length of the applicable trial period to accept and take ownership of your template.
If you do not accept the template during the available trial period, allow the trial to expire, or allow Squarespace to delete the website, we are not responsible for restoring or recreating the template.
If the template needs to be prepared and supplied again because you did not accept it or allowed the trial website to expire or be deleted, you will need to purchase a new template licence.
We recommend upgrading your website to an appropriate Squarespace subscription or contacting Squarespace regarding your trial before its expiry rather than allowing the website to lapse.
7. SQUARESPACE SUBSCRIPTION AND DOMAIN
A Squarespace subscription is not included in the purchase price of your template.
You are responsible for selecting, purchasing and maintaining the Squarespace subscription required to publish and operate your website.
A domain name is also not included unless expressly stated otherwise.
You are responsible for purchasing, connecting, renewing and managing your domain and any related services.
Any fees charged by Squarespace, domain providers or other third parties are separate from your template purchase.
8. CANCELLATION RIGHTS FOR DIGITAL CONTENT
If you are purchasing as a UK consumer, you would normally have a 14-day cancellation period for a distance contract.
However, digital content may be supplied during that cancellation period where you expressly consent to supply beginning immediately and acknowledge that you will lose your right to cancel once supply of the digital content begins.
At checkout, you may therefore be asked to confirm that:
you expressly request immediate supply of the digital content and acknowledge that you will lose your statutory 14-day right to cancel once supply of the digital content begins.
Once we begin supplying your template following that consent and acknowledgement, your statutory right to cancel the purchase simply because you have changed your mind will end.
Nothing in this section affects any statutory rights you may have where digital content is faulty, not as described or otherwise does not conform to the contract.
9. REFUNDS
Because our templates are digital products that cannot practically be returned once supplied, we do not offer refunds for:
* change of mind after your cancellation right has ended;
* choosing the wrong template;
* deciding you no longer wish to build a website;
* failure to use the template;
* purchasing a template that does not suit your personal design preferences;
* failure to read the template description, requirements or FAQs before purchasing;
* problems resulting from changes you make to the template;
* allowing your Squarespace trial to expire;
* failing to accept your template within the trial period; or
* purchasing a product without checking that you have the necessary technology or services to use it.
This does not exclude your statutory rights.
If the digital content supplied to you is faulty, materially different from its description or otherwise fails to meet rights that cannot lawfully be excluded, please contact us at support@thevisibletherapist.co.uk so that we can investigate and provide any remedy required by applicable law.
10. YOUR TEMPLATE LICENCE
When you purchase a template, we grant you a non-exclusive, non-transferable licence to use that template for one website for one business only.
You do not acquire ownership of the underlying template design, intellectual property or copyright.
You may customise your licensed website for your own business, including changing its:
* colours;
* fonts;
* copy;
* photographs;
* graphics;
* page content;
* sections; and
* layouts.
You may use your completed website commercially for the business for which the template was purchased.
You do not have to display a design credit to The Visible Therapist unless a particular product expressly states otherwise.
11. ONE TEMPLATE = ONE WEBSITE
Each template purchase provides one licence for one website.
You may not use one template purchase to create websites for multiple businesses, practices, brands, organisations or clients.
If you wish to use the same template for another website or business, another licence must be purchased.
You may duplicate your website within Squarespace for reasonable backup, staging or testing purposes relating to the same licensed business.
A duplicated site must not be used to create a website for another business, client, person or commercial project.
12. PROHIBITED USE
You may not:
* sell, resell or redistribute the template;
* share the template with another person or business;
* provide another person with a duplicate of the template;
* use one purchase to create multiple live websites;
* use the template to create websites for clients;
* claim the underlying template design as your own original design;
* sell or distribute modified versions of the template;
* use the template as the basis of another template offered for sale or distribution;
* extract pages, sections or design elements from the template for use in unrelated websites or commercial template products;
* reproduce or distribute our tutorials, guides, resources or other accompanying materials;
* remove or circumvent copyright, licensing or other intellectual property protections;
* use the template for an unlawful or fraudulent purpose; or
* use the template in a way that infringes the intellectual property or other rights of another person.
13. INTELLECTUAL PROPERTY
The underlying template designs and materials created by The Visible Therapist remain the intellectual property of Autumn Creative Ltd.
Purchasing a template gives you permission to use the design in accordance with the licence contained in these Terms. It does not transfer copyright or ownership of the original template design to you.
All rights not expressly granted to you under these Terms are reserved.
Third-party materials contained within a template remain the property of their respective owners and may be subject to separate licence terms.
14. DEMO PHOTOGRAPHY
Photography shown within our template demos is used for demonstration purposes only unless expressly stated otherwise.
Demo photographs are not licensed to you as part of your template purchase and must be replaced with your own appropriately licensed photographs before publishing your website.
You are responsible for ensuring that you have the necessary rights and permissions to use any photography you add to your website.
We are not responsible for copyright or licensing issues arising from photographs or other content added to the website by you.
15. FONTS, GRAPHICS AND ILLUSTRATIONS
Our templates use fonts available through Squarespace unless otherwise clearly stated.
Where a template includes graphics or illustrations that are supplied as part of the template design, you may use those elements as part of your licensed website.
That permission does not allow you to extract, resell, redistribute or supply those graphics or illustrations separately from the licensed website.
Where an asset is supplied under a third-party licence, your use of that asset will also be subject to any applicable terms imposed by the original rights holder.
You may also receive a resource guide containing suggestions and links to sources for images, graphics or other website resources.
Unless expressly stated otherwise, resources recommended or linked within that guide are provided by third parties. You are responsible for checking and complying with the applicable licence terms before using them.
16. YOUR CONTENT AND LEGAL RESPONSIBILITIES
Once the template has been transferred to you, you are responsible for the content you add to and publish on your website.
This includes responsibility for:
* your website copy;
* photographs and images;
* branding;
* downloadable resources;
* claims about your services;
* professional or regulatory information;
* privacy notices;
* cookie requirements;
* accessibility;
* copyright;
* data protection;
* terms and policies applicable to your own business; and
* compliance with any professional, ethical, regulatory or legal obligations that apply to your practice.
The Visible Therapist does not provide legal, regulatory or compliance advice through the purchase of a website template.
You are responsible for ensuring that your finished website is appropriate for your particular practice, services, jurisdiction and professional obligations.
17. TEMPLATE CUSTOMISATION AND ACCIDENTAL CHANGES
Once ownership of the website has been transferred to you, you are responsible for editing, maintaining and managing it.
We recommend making a backup or duplicate of your website before carrying out substantial changes.
We cannot be responsible for accidental deletion, editing or alteration of template content after ownership has been transferred.
Template support does not include restoring the original design after you have substantially altered or deleted it.
If a complete replacement copy of the original template is required, a further template purchase may be required.
18. SUPPORT
Your template purchase includes access to the tutorials, guides and resources described on the relevant product page together with 6 months of email support relating to the template itself.
The 6-month support period begins from the date your template is supplied.
Template support covers reasonable questions relating to:
* accessing your purchased template;
* the original template design;
* the tutorials and resources supplied with your purchase;
* technical issues that appear to arise from the original template as supplied; and
* problems with files or resources supplied directly by The Visible Therapist.
Support does not include:
* general Squarespace training beyond the resources provided;
* custom website design;
* template customisation carried out for you;
* custom CSS or coding;
* modifications to custom code;
* troubleshooting problems caused by code or modifications added by you or a third party;
* problems with your computer, browser, internet connection or software;
* problems with your email provider;
* domain configuration or domain provider issues;
* third-party software, plugins or integrations;
* copywriting;
* bespoke SEO work; or
* problems resulting from changes made by Squarespace after the template was supplied.
Where additional support or design work is available, it may be offered as a separate paid service.

19. SEARCH ENGINE OPTIMISATION
Our templates are structured to allow you to use Squarespace’s foundational SEO features, including areas for page titles, meta descriptions and image alt text.
Any SEO guidance included with your template relates to these foundational website settings unless expressly stated otherwise.
A template purchase does not include a comprehensive SEO strategy, keyword research, ongoing SEO management, backlink building or specialist SEO consultancy.
We do not guarantee:
* search engine rankings;
* website traffic;
* enquiries;
* conversions;
* client bookings; or
* business growth.
Search performance depends on many factors outside our control, including your content, competition, location, website authority, marketing activity and changes made by search engines.
20. TEMPLATE VERSION AND FUTURE UPDATES
Your purchase is for the version of the template available at the time of purchase.
Templates do not update automatically after they have been transferred to your Squarespace account.
We may alter, update, redesign or retire templates in the future.
You are not automatically entitled to receive a future updated, redesigned or replacement version of a template you have previously purchased.
Significant redesigns or replacement versions may be offered as separate products.
21. SQUARESPACE AND THIRD-PARTY SERVICES
Squarespace is a third-party platform that we do not own or control.
Squarespace may change its:
* software;
* features;
* interface;
* functionality;
* subscriptions;
* prices;
* trial periods;
* policies; or
* availability.
We are not responsible for changes made by Squarespace after your template has been supplied.
We design our templates to operate with the relevant Squarespace platform and functionality available at the time the template is offered for sale, but we cannot guarantee that future Squarespace changes will not affect the appearance or operation of a template.
You are also responsible for any third-party products, software, booking platforms, email marketing services, analytics tools or other integrations you choose to connect to your website.
Their use is subject to the relevant third party’s own terms, privacy policies, fees and technical requirements.
22. WEBSITE SECURITY AND MAINTENANCE
Once ownership of the template website has been transferred to you, you are responsible for managing your Squarespace account and website.
This includes maintaining appropriate account security, passwords, permissions, billing and any connected third-party services.
We cannot guarantee that any website or online service will always be available, uninterrupted or immune from security incidents.
We are not responsible for outages, security incidents or loss caused by Squarespace or another third-party service unless the loss arises directly from something for which we are legally responsible.
23. TEMPLATE AVAILABILITY
We may modify, retire or discontinue any template at any time.
This will not affect your licence to continue using a template that has already been validly purchased and transferred to you.
Retired templates may no longer receive updates to tutorials, documentation or compatibility information.
24. NO GUARANTEE OF RESULTS
Our templates are designed to provide a professional starting point for creating a therapy or counselling website.
However, purchasing or using a template does not guarantee any particular business or marketing result.
We cannot guarantee that your website will generate enquiries, clients, bookings, revenue, search engine rankings or any other particular outcome.
Your results will depend on factors including your services, location, audience, content, marketing, SEO, reputation and how you customise and use your website.
25. REVIEWS, TESTIMONIALS AND TEMPLATE SHOWCASES
We may invite you to provide a review or testimonial following your purchase.
If you voluntarily submit a review or testimonial, you give us permission to reproduce and display it for reasonable promotional purposes, including on The Visible Therapist website, social media and marketing materials.
We may also showcase examples of completed websites created using our templates, including through screenshots or links to publicly available websites, for the purpose of demonstrating our templates and work.
Where appropriate, we will respect reasonable requests concerning the use of your business name, website or testimonial in our marketing.
26. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any statutory consumer rights that cannot legally be excluded or restricted.
Subject to those protections, to the fullest extent permitted by law, Autumn Creative Ltd will not be liable for indirect or consequential loss arising from your use of a template, including loss of profits, revenue, business opportunity, anticipated savings or data.
We are not responsible for loss caused by:
* your modification or misuse of the template;
* failure to maintain your Squarespace account or subscription;
* failure to maintain backups where reasonably appropriate;
* third-party software or services;
* Squarespace outages or platform changes;
* content supplied or published by you;
* failure to comply with third-party licences; or
* circumstances outside our reasonable control.
Where it is lawful to limit our liability, our total liability arising directly from a template purchase will not exceed the amount you paid for that template.
Nothing in these Terms affects rights or remedies which cannot legally be limited or excluded.
27. FORCE MAJEURE
We will not be responsible for delay or failure to perform an obligation under these Terms where that delay or failure is caused by circumstances outside our reasonable control.
This may include internet or hosting failures, Squarespace outages, payment processor failures, serious technical problems, power failures, illness, natural disasters or other events that we could not reasonably prevent.
Where such an event affects template delivery, we will make reasonable efforts to complete delivery as soon as reasonably practicable.
28. PAYMENT DISPUTES AND CHARGEBACKS
If you believe there is a problem with your purchase, please contact us at support@thevisibletherapist.co.uk in the first instance so that we have an opportunity to investigate and resolve the matter.
Nothing in this section prevents you from exercising any rights you have through your payment provider or under applicable law.
Where a payment dispute or chargeback is raised, we may provide the payment provider with relevant evidence relating to the transaction, including order details, evidence of template delivery and your agreement to these Terms.
29. TERMINATION OF YOUR LICENCE
We may terminate your licence to use a template if you materially breach the licensing or intellectual property provisions of these Terms.
Examples include:
* reselling the template;
* distributing copies to other people;
* using one licence for multiple businesses or websites; or
* creating templates or client websites from the design in breach of these Terms.
Where appropriate, we may first ask you to remedy the breach.
Termination of your licence does not transfer any intellectual property rights to you and does not prevent us from taking action to protect our intellectual property where necessary.
30. INTERNATIONAL CUSTOMERS
We currently accept template purchases from customers located in the United Kingdom, United States and Canada.
Customers outside the United Kingdom are responsible for checking whether the template and their use of it comply with any laws, professional rules or regulatory requirements that apply to them.
These Terms are governed by the law of England and Wales as set out below.
However, if mandatory consumer protection laws in your country or territory apply to your purchase and cannot legally be excluded by contract, nothing in these Terms is intended to remove those rights.
31. PRIVACY
We process personal data relating to your purchase and use of our website in accordance with our Privacy Policy, available on The Visible Therapist website.
Our checkout, payment processors, Squarespace and other services involved in fulfilling your purchase may also process personal data under their own privacy policies.
32. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our products, business practices, technology or legal requirements.
The date shown at the top of these Terms identifies the most recent version.
The Terms applying to your template purchase will normally be those in effect when you placed your order.
Changes made after your purchase will not retrospectively remove contractual or statutory rights you already have.
33. GOVERNING LAW AND DISPUTES
These Terms and any dispute or claim relating to them are governed by the laws of England and Wales, subject to any mandatory rights that apply to consumers located elsewhere.
If a problem arises, please contact us first at support@thevisibletherapist.co.uk so that we can try to resolve it.
If a dispute cannot be resolved directly, the parties may consider an appropriate alternative dispute resolution process where applicable.
Nothing in these Terms prevents either party from exercising any right to bring proceedings before a court with jurisdiction to hear the dispute.
34. SEVERABILITY
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified only to the extent necessary.
The remaining provisions will continue to apply.
35. ENTIRE AGREEMENT
These Terms, together with the product description, Privacy Policy and any other terms expressly incorporated into your purchase, form the agreement relating to your template purchase.
Nothing in this section excludes liability for fraudulent statements or affects statutory rights that cannot legally be excluded.
36. SQUARESPACE TRADEMARK AND AFFILIATION
Squarespace is a trademark of Squarespace, Inc.
The Visible Therapist and Autumn Creative Ltd are independent businesses and are not owned, operated or endorsed by Squarespace, Inc.
Our Squarespace templates are independently designed products created for use with the Squarespace platform.
